Website and Purchase Terms

These general terms cover the MerginIT website and explain how checkout-provider terms and product-specific agreements fit together.

1. Provider

This website is provided by MerginIT e.U., Jonas Fröller, Nußböckstraße 92, 4060 Leonding, Austria. Contact support@merginit.com. Full company information appears in the imprint.

2. Scope and order of terms

These terms apply to use of merginit.com. A product page, software licence, service terms, or other supplier agreement may contain product-specific rules. Those product-specific terms govern the product. The buyer terms of the checkout provider named before payment govern the checkout, payment, tax, invoicing, and transaction services supplied by that provider.

3. Purchases

Before placing an order, review the product, supported systems, price, billing period if any, licence scope, and checkout provider shown on the order page. Prices, taxes, and accepted payment methods are confirmed in checkout. A binding order is formed as described in the buyer terms shown there. The order confirmation and receipt are provided electronically.

MerginIT develops, licenses, delivers, and supports its products. Lemon Squeezy is the Merchant of Record for direct Dupe Zappa purchases, Polar for Brand Peel and Markdownblog, and Paddle for OCRMD. Microsoft is responsible for Microsoft Store transactions. See Payment Providers for details.

4. Product licences and services

Purchasing software does not transfer ownership of the software or its intellectual property. The applicable product terms grant the right to use it and state any device, user, transfer, update, subscription, or account limits. For example, Dupe Zappa has its own software licence terms on its product website.

5. Acceptable website use

  • Do not interfere with the website, security controls, or availability.
  • Do not use automated access in a way that places an unreasonable load on the service.
  • Do not use MerginIT content, services, or contact channels unlawfully.
  • Do not misrepresent affiliation with MerginIT or another person.

6. Intellectual property

Unless a separate licence states otherwise, website text, design, graphics, software, product names, and other materials are owned by or licensed to MerginIT. You may view the public website for personal or internal business purposes. No other rights are granted by implication.

7. Availability and external links

MerginIT may maintain, improve, or discontinue website features. External links are provided for convenience and are governed by the destination's terms and privacy practices. Nothing in this section limits a paid customer's contractual or mandatory statutory rights.

8. Warranty and liability

Mandatory statutory warranty rights remain unaffected. To the extent permitted by law, MerginIT is liable under the applicable statutory rules for intent, gross negligence, personal injury, and other liability that cannot lawfully be limited. Any additional product warranty or liability terms appear in the relevant product agreement.

9. Refunds and withdrawal

The Refund and Withdrawal Policy explains statutory rights and the correct request route. Nothing in these terms excludes non-waivable consumer rights.

10. Governing law

Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protections of the country in which they habitually reside, and mandatory jurisdiction rules remain unaffected.
